Does the dog have a crate to sleep in? If so, put him in his crate, if he starts whining, rap on the crate and say firmly 'no, no whining!' If you think he needs to go outside, tell him no, then wait for him to quiet down, then take him out. You don't want him to associate whining with getting what he wants, he should get what he wants when he's doing what you want him to ;)
